Compliance in respect of the legislation governing the payment of employees is a veritable minefield at times from the definition of an employee, processing the various types of court orders through making the final payments to a leaver and the requisite filing required to HM Revenue and Customs.
In addition there are considerations to be made in relation to record keeping, eligibility to work and the payments of expenses and treatment of benefits.
This legislation is forever changing and all employers are expected to know about the changes and ensure that they are implemented as appropriate.
Failure to do so not only means that employees may not have been correctly paid with the correct deductions made and paid over but may also result in penalties for not operating the correct procedures or filing the correct returns on time plus and interest on any underpaid tax and NICs.
And as in all cases its not knowing what you don’t know. If the person responsible for the payroll doesn’t keep themselves up to date then they may not realise there have been changes and this would also require them to know about changes in case law.
